Polygamy and How the Indonesian Constitution Court Interpreted the Koran

Tri Sulistianing Astuti and Luthfi Eddyono presented their paper “Polygamy and How the Indonesian Constitution Court Interpreted the Koran” in the International Conference on Scripture for Peace and Humanity: Scriptural Reasoning, Contextualist Approach, and Social Reception.

The International Conference on Scripture for Peace and Humanity was an event held in Yogyakarta, Indonesia, on June 20-21, 2023, focusing on how scripture is interpreted for peace or conflict. The conference aimed to bring together scholars from various religious traditions to examine the role of scriptural reasoning and contextualist approaches in promoting tolerance or intolerance. It also explored the social reception and impact of different scriptural interpretations.

The Debate Surrounding Halal Certification in Indonesia

Tri Sulistianing and Luthfi Widagdo Eddyono presented their paper on Halal Certification in Indonesia at a two-day farewell symposium honoring the esteemed career of Prof. Nico Kaptein. The event, titled “Farewell Symposium – Prof. Nico Kaptein: From the Past to the Future: Islam and Religious Authority in Indonesia,” was organized in collaboration between the Faculty of Islamic Studies at the Indonesia International Islamic University (UIII) and the Office of Leiden University in Indonesia, and took place on August 29-30, 2023.

The symposium, which took place at the UIII campus in Depok, brought together prominent academics, researchers, and students interested in the intersections of Islam, society, and religious authority in Indonesia. Prof. Kaptein’s retirement marked the end of a distinguished career as Professor of Islam in Southeast Asia at the Leiden University Institute for Area Studies, officially retiring in May 2023. Throughout his career, he has made significant contributions to the scholarship of Islam and Muslim societies in Indonesia.

Integrative Negotiation Approach by the Indonesian Constitutional Court in Concurrent General Elections Policy

Abstract

The Indonesian Constitutional Court has rejected the judicial review of concurrent general elections’ constitutionality in Decision No. 55/PUU-XVII/2019 on 26 February 2020. The Constitutional Court rejected the entire judicial review of Law No.7/2017 considering General Elections and Law No. 1/2015 considering Regional Head Elections. Association for Elections and Democracy (Perkumpulan Untuk Pemilu dan Demokrasi (Perludem)) submitted this issue as the 2019 concurrent general elections with the five-box design were inconsistent with the Election Principles in the Indonesian Constitution 1945 (UUD 1945). Surprisingly, the Constitutional Court decided on six possible models in the concurrent general election besides the rejection. Even though this decision was issued before pandemic Covid-19, the options significantly impact the next concurrent general elections in the new-normal era. This paper reviews the dynamics of the decision-making process on the concurrent general elections policy in an integrative negotiation approach to understanding the Constitutional Court by juridical method and desk study. Through analyzing Decision No. 55/PUU-XVII/2019, it appeared that the Constitutional Court has succeeded in accommodating the petitioner’s necessities and referring to the implementation of elections policy effective and efficient according to the mandate of UUD 1945. In conclusion, the integrative negotiation approach applied in the decision-making process produced the six best possible options to conduct simultaneous elections in a new-normal society.

Satire and Freedom of Speech

On the final session of “The 4th Indonesian Constitutional Court International Symposium (also known as 2021 ICCIS), Tri Sulistianing Astuti, Team Leader of Center for Democratization Studies, Jakarta present her paper.

Astuti shared about the freedom of speech and religion as the fundamental rights of everyone in a democratic country. She believed that freedom of speech allowed the media to find the truth in the form of innuendo and satire as an expression. However, she admitted that innuendoes and satire as a way of expressing and finding truth did more harm than good to the religious aspect of the society. She took the example of a satire cartoon called Charlie Hebdo which became an issue of debate. 

In her research, Astuti aimed to answer  2 (two) questions. First, how freedom of speech and religion got mixed and tangled in innuendoes or satire. Second, how the government created the boundary concerning religion-related satire based on the proportionality test for Indonesians as religious issues were easily misused and resulting in violence. 

“As a conclusion, religious innuendos or satire as an expression should be restricted in the case of blasphemy based on the proportionality contained in Article 28J Paragraph (2) of the constitution. It (the restriction) considers the contain and purpose of the innuendoes, writer’s role, political context while respecting the ethics, races, and others. That the sensitive issue among the religious community in Indonesia and restriction of those expressions should be regulated in laws to prevent the misunderstanding of religion-related satire and causing it to be blasphemous in the Court’s decision,” she explained.  

On a side note, the international symposium would be held on 15-16 September 2021 using the hybrid method (virtual and on-site) in Bandung, West Java. Previously, the Court had hosted similar programs: 2017 ICCIS in Solo, 2018 ICCIS in Yogyakarta, and 2019 ICCIS in Bali. Due to the pandemic, the program was halted in 2020. ICCIS itself was a global academic forum held annually to discuss the matters, ideas, and challenges of constitutional law, human rights, and democracy. This year it focused on religious issues in the context of constitutional rights. The Center of Case Research of the Constitutional Court opened the chance for academics to send out their articles and selected articles would publish in the Court’s journal called Constitutional Review.

Diskusi: Seluk Beluk Kampanye Pemilu 2024 dan Keberadaan Pemantau Pemilu

Pada 9 Juni 2022, Komisi Pemilihan Umum (KPU) telah menerbitkan Peraturan Komisi Pemilihan Umum Nomor 3 Tahun 2022 tentang Tahapan dan Jadwal Penyelenggaraan Pemilihan Umum. Tahapan pertama akan dimulai pada tanggal 14 Juni 2022. Tahapan terpenting yaitu pemungutan suara dilakukan pada tanggal 14 Februari 2024 dan 26 Juni 2024 untuk pemilihan Presiden/Wakil Presiden putaran kedua jika ada. Seluruh tahapan akan berakhir pada 20 Oktober 2024 dengan pengucapan sumpah/janji pemenang Pemilu.


Keseluruhan terdapat 11 tahapan penyelenggaraan Pemilu 2024, yaitu: perencanaan program dan anggaran serta penyusunan peraturan pelaksanaan penyelenggaraan Pemilu; pemutakhiran data Pemilih dan penyusunan daftar Pemilih; pendaftaran dan verifikasi Peserta Pemilu; penetapan Peserta Pemilu; penetapan jumlah kursi dan penetapan daerah pemilihan; pencalonan Presiden dan Wakil Presiden serta anggota DPR, DPD, DPRD provinsi, dan DPRD kabupaten/kota; masa kampanye Pemilu; Masa Tenang; pemungutan dan penghitungan suara; penetapan hasil Pemilu; dan pengucapan sumpah/janji Presiden dan Wakil Presiden serta anggota DPR, DPD, DPRD provinsi, dan DPRD kabupaten/kota.

Diskusi ini akan mengulas mengenai Seluk Beluk Kampanye Pemilu 2024 dan Keberadaan Pemantau Pemilu yang sangat penting untuk mengkaji proses penyelenggaraan Pemilu 2024 yang sudah dimulai.

UUD 1945 merupakan konstitusi tertulis Negara Republik Indonesia yang menjadi landasan utama pengaturan kehidupan berbangsa dan bernegara. Keberadaan konstitusi bagi suatu negara hakekatnya adalah untuk membatasi kekuasaan negara agar tidak bertindak sewenang-wenang. Konsepsi konstitusi tersebut lahir dari konstitusionalisme, yaitu faham mengenai pembatasan kekuasaan dan jaminan hak-hak rakyat melalui konstitusi dan meletakkan konstitusi sebagai perwujudan dari hukum tertinggi yang harus dipatuhi oleh negara dan penyelenggara pemerintahan. Oleh karenanya, perubahan konstitusi harus tetap mengacu kepada gagasan dasar konstitusionalime tersebut. Diskusi ini akan membahas dinamika dalam upaya untuk amendemen atau perubahan tersebut.

The program features lectures by eminent scholars and practitioners in the fields of human rights and democracy.

Fauziah Eddyono, Team Leader for Economic and Development, will participate in the Istanbul Seminars 2015 with grant from the Reset-Dialogues on Civilizations. The 8th edition of the Istanbul Seminars will be held on May 26-30, 2014 at Istanbul Bilgi University. Topic: “Politics Beyond Borders. The Republican Ideal Challenged by the Internationalization of Economy, Law and Communication.” The conference takes place at Istanbul Bilgi University and attracts a considerable audience of scholars and students from all over the world.
